CHEF BENTO 2019 FULL TERMS AND CONDITIONS 

Introduction

  1. This document outlines the Terms and Conditions for Competitions run by Bento&co.
  2. By entering a competition entrants accept these terms and conditions together with any specific instructions and terms for such competition which may be mentioned in any social media platform and/or pages run by Bento&co, or on Bento&co websites, or communicated to entrants in any other way.
  3. In the event of a discrepancy between these standard terms and conditions and the details in the promotional material (or any other terms and conditions provided/referred to at the time of entry), the details of the promotional material (and any other terms and conditions provided/referred to at the time of entry) shall prevail.
  4. Competition details form part of these terms and conditions.
  5. Bento&co’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into. 

Eligibility

  1. The competition is open to worldwide to people who are over 18 years of age at the time of submitting the entry.
  2. Only one entry submitted per person will be accepted. Multiple entries will not be counted.
  3. By entering the competition, Entrants warrant that they will take responsibility for any/all fees incurred apart from the two prize fees given to the winners.
    1. Grand prize winners: Additional costs during the trip (extended period of stay, transportation, meals, activities etc.) will not be included. The dates of these trips will be determined after the contest has closed as per the contest rules. Bento&co will not be held responsible for any issues that may occur while the winners are on these trips.
    2. Finalists:By entering the competition, Entrants warrant that they will take responsibility for any/all customs fees that may be incurred. Bento&co does not accept any responsibility for any/all customs fees incurred.
  4. By entering the competition entrants warrant that all information submitted by them is true, current, and complete. Entrants also warrant that they are the copyright owners of any copyright works submitted, and Bento&co’s use of such works (which Entrants will permit) will not infringe the rights of any third party.
  5. The competition is not open to employees of Bento&co and their family, close relatives, friends, and/or anyone otherwise connected with the organization or judging of the competition.
  6. By entering the competition, Entrants warrant that they will take responsibility for any/all customs fees that may be incurred. Bento&co does not accept any responsibility for any/all customs fees incurred.

Entry

  1. All entries must be made directly by the person entering the competition.
  2. Only one entry submitted per person will be accepted. Multiple entries will not be counted.
  3. The opening and closing dates and times for entries are as indicated in the competition information. Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition.
  4. There is no purchase necessary to enter this competition. However, by entering the competition, Entrants warrant that they will take responsibility for any/all customs fees that may be incurred. Bento&co does not accept any responsibility for any customs fees incurred.
  5. In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of the entry or any answers given by entrants (if applicable), or the operation of any part of the competition, network or phone system etc the decision of Bento&co shall be final and no correspondence will be entered into.
  6. Any personal data relating to the winner or any other entrants will be used solely in accordance with data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
  7. In the case of void and/or invalid entries:
    1. Any entrant who enters or attempts to enter the Competition in a manner, which in Bento&co’s determination is contrary to these terms and conditions or by its nature is unfair to other entrants may be removed from the Competition at Bento&co’s sole discretion.
    2. No responsibility can be accepted for entries not received for whatever reason, including entries lost, delayed or corrupted, or due to computer error in transit.
    3. Use of a false name or address will result in disqualification.
    4. Entries that are incomplete, illegible, indecipherable, or inaudible will not be valid and will be deemed void.
    5. Entries made online using methods generated by a script, macro, or the use of automated devices will be void.

Competition Details Summary

  1. The opening and closing dates and times for entries are as indicated in the competition information. Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition.

Entry Dates and Requirements

  1. Chef Bento 2019 Contest starts on 15 April 2019 at 9am JST, and ends on 21 May 2019 5pm JST.
  2. The 10 finalists and the 2 Grand Winners will be announced on 24 May 2019 by 5pm JST at the latest.
  3. The ranking of the 10 finalists will be decided through an online public vote via the Bento&co website. Voting will close 30 May 2019 by 5pm JST latest.
  4. The ranking of the 10 finalists, decided by the public votes, will be announced on 31 May 2019 by 5pm JST latest.

Entry restrictions:

  1. The Bento must be for 1 person.
  2. The bento box must be of one or two tiers maximum. No picnic or XL boxes allowed.
  3. As we can't taste your bento, visuals are the single most important factor for assessment: your bento should be well presented and photogenic!
  4. Submit 2 photos featuring your completed International Bento! 1 photo should include a physical country flag (not digitally added! Hand drawn flags are also accepted) referencing the origin of the featured cuisine (the flag can be positioned anywhere in the photo; it doesn't have to be in the bento). The other photo should be of the same bento, just without the country flag! 
    Entry submission requirements:
    1. Each contestant can enter only once (2 photos per person; 1 photo should include a physical country flag (not digitally added! Hand drawn flags are also accepted) referencing the origin of the featured cuisine (the flag can be positioned anywhere in the photo; it doesn't have to be in the bento). The other photo should be of the same bento, just without the country flag! )
    2. All entries must be submitted via the entry form in order to be considered.
    3. Please do not attach a watermark! By participating in the contest, the contestant agrees that the photos submitted for the contest can be utilized on Bento&co's website and related social media sites (online shops, blogs, social media such as Facebook, Twitter, etc.).

    Prizes

    1. The prize is as specified in the competition information.
    2. The prizes are non-transferable and non-exchangeable, and no cash or other alternatives will be offered other than what is outlined below. Prizes are subject to availability and Bento&co reserves the right to substitute any prize with another of equivalent value without giving notice.

    2. Four (4) winners will be selected from all entries received and verified by Bento&co.
    3. Winners will be announced 24 May 2019 by 5pm JST at the latest, unless otherwise stated.
    4. The winners will be contacted on the contact information they provided when entering the competition, as well as through any pre-existing contact methods in Bento&co’s database.
    5. If the winner cannot be contacted or does not claim the prize within seven (7) days of notification and/or provide an address for delivery of the prize or are unable to comply with these terms and conditions, this may result in forfeiture of the prize and Bento&co reserves the right to select an alternative winner in accordance with these terms and conditions and the competition information.
    6. Grand Winner 1 (Residing outside of Japan): One grand winner will be chosen from contestants who are residing outside of Japan. The prize is a round trip plane ticket to Japan for one person.
      1. The flight is to KIX International Airport Japan, and must be used before the end of 2019. Further details will be arranged directly with the winner.
    7. Grand Winner 2 (Residing within Japan):  One grand winner will be chosen from contestants who are residing within Japan. This person will be awarded a single night's stay for two people at a luxury hotel in Kyoto.
    8. Additional costs during the trip (extended period of stay, transportation, meals, activities etc.) will not be included. The dates of these trips will be determined after the contest is over. Bento&co will not be held responsible for any problems that may occur while the winners are on these trips.
    9. Top 10 Finalists: each finalist will receive gifts from Bento&co partners. The ranking of the top 10 finalists, determined by votes, will also determine the prizes awarded to them.  By entering the competition, Entrants warrant that they will take responsibility for any/all customs fees that may be incurred. Bento&co does not accept any responsibility for any/all customs fees incurred.
    10. Every submission entered in accordance with the contest rules and terms & conditions will receive  a one-time 10% discount for the Bento&co website.

    Privacy

    1. The winners agree to use of their name, disclosure of country of residence, and their entry and will cooperate with any other reasonable requests by Bento&co related to any post-winning publicity.
    2. Any personal data relating to the winner or any other entrants will be used solely in accordance with data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

    Liability

    1. Bento&co reserves the right in its sole discretion to withhold delivery of the prize until any requested proof of eligibility and identity has been confirmed or if such proof is not produced on request or to disqualify the entrant from the competition.
    2. Bento&co may in its sole discretion refuse to provide a prize, or seek its recovery, in the event of non-entitlement under these terms or an entrant’s breach of these terms, Bento&co’s website terms of use, fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an entrant to evade charges or entry requirements.

    Publicity (Copyright) and Data Protection

    1. Entrants warrant to Bento&co that they created their competition entries, that they own all of the copyright in those entries, and that Bento&co’s use of the entries in accordance with these rules will not infringe any person's intellectual property rights or other legal rights.
    2. Entry into the competition warrants that Entrants have all necessary rights to provide the intellectual property to Bento&co and consent to any act or omission which would otherwise constitute an infringement of their intellectual property.
    3. Entrants grant to Bento&co a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, copy, store, edit, distribute, transmit and publish their competition entries.
    4. This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Twitter, or any other Social Network. Entrants are providing their information to Bento&co and not to any other party.     Liability

    1. Bento&co reserves the right at its sole discretion and at any time to cancel or modify the competition, competition information, and these terms and conditions without prior notice. Such changes will be effective immediately upon posting to this webpage. Any changes will be posted either within the competition information or these terms and conditions.
    2. Bento&co reserves the right to modify, cancel, terminate or suspend the Competition in whole or in part, at its sole discretion, if it believes the Competition is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of Bento&co that could corrupt or affect the administration, security, impartiality, or normal course of the Competition.
    3. Bento&co shall not be responsible for technical errors in telecommunication networks, internet access or otherwise, preventing entry into the competition.
    4. Neither Bento&co nor its servants, agents, nor any other party or organization involved in the management, promotion, or administration of the competition or its entry routes or donation of prizes or their agents or subsidiaries involved in the competition will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions (including but not limited to security functions by software used by Bento&co or any third party), virus, bugs, or other causes outside its control.

    Jurisdiction

    1. The competition and these terms and conditions will be governed by Japanese law, and any disputes will be subject to the exclusive jurisdiction of the courts of Japan.
